u4Bear User Agreement

At u4Bear, user safety and strict legal compliance are the cornerstones of our platform. We operate a zero-tolerance policy for illegal content, non-consensual content, or content involving minors. Our moderation protocols exceed industry standards and are designed to ensure a safe environment for our adult community.

1. 100% Pre-Publication Moderation (Public and Private Content)
We do not rely solely on user reports. All content, without exception — whether uploaded to a public profile or exchanged in private messages — is subject to a rigorous and mandatory review process before being published or delivered.
- Hybrid review (Automated and Human): Content is first analyzed by a multi-layer Artificial Intelligence infrastructure (using Amazon Rekognition, Llama 3, OpenAI, and Google Vision).
- Final human approval: Our specialized human moderation team reviews and makes the final decision on all content. Nothing is published or delivered on u4Bear without passing through this exhaustive filter.

2. Immediate Removal and 12-Hour SLA Resolution
In the highly unlikely event that inappropriate content bypasses our pre-publication filters, we provide our users with immediate reporting tools.
- Instant automatic removal: The moment a user reports content (including claims for non-consensual content or copyright violations), it is automatically and immediately removed from both public and private visibility.
- 12-hour SLA: All reports are escalated to our human moderation team and definitively resolved in less than 12 hours. Always.

3. Strict Age Verification and Child Protection
u4Bear is strictly for adults. We use our own age verification gateway, TrustMyAge, which uses a double-blind verification process combining AI and human review to confirm legal age, in compliance with user privacy laws.
- Any user detected attempting to impersonate a minor or falsify their age is expelled immediately and permanently.

4. Law Enforcement Collaboration and Evidence Preservation
We maintain a direct and close operational relationship with the Spanish Civil Guard (Computer, Technological and Economic Crime Unit).
- Offline evidence quarantine: If our filters or moderators detect any activity that constitutes a possible crime, the content is never published. Instead, it is immediately isolated, encrypted, and transferred to a secure, offline server (with no network access) to preserve the chain of custody.
- We proactively report suspicious activities and grant priority access to law enforcement authorities upon any legal request.

5. Device-Level Blocking (UUID)
We do not merely block accounts; we block devices. Users expelled for serious violations (such as attempts by minors to access the service or illegal content) are subject to device-level blocks (UUID), ensuring they cannot simply create a new account to circumvent our security measures.

2.- License Grant and Use
2.1 - u4Bear grants you a limited and temporary user account license to access the site and use its services in accordance with these terms and the instructions and guidelines published on u4Bear.
2.2 - u4Bear reserves the right to cancel, withdraw, limit and/or terminate this license grant to use the site and services at any time and for any reason. u4Bear has no obligation to disclose or explain the reasons for this action.
2.3 - You do not become, in any form, the holder of said license, nor of any of the services obtained through it.
2.4 - You shall have no right to claim or receive compensation of any kind in connection with this grant, either during its use or in the event that the corresponding license is withdrawn.
2.5 - You shall be solely responsible for the use you make of this license grant during the period of grant or outside this period if the activities were carried out during its concession. u4Bear shall not be responsible, under any circumstances, for the acts you perform with the license granted to you.

3.- Warranty and Limitation of Liability
3.1 - u4Bear offers the services and the site "as is", without any express, implied or statutory warranty or condition. u4Bear specifically disclaims any warranty of use, merchantability, fitness for a particular purpose, non-infringement, accuracy of information, integration, interoperability or enjoyment. In the event that your country and/or state does not permit the limitation of implied warranties, this prior disclaimer may not apply to you.

3.2 - You understand and agree that your use of the site and services is at your own discretion and risk, and that you will be solely responsible for any damages arising from such use. Under no circumstances shall u4Bear be liable for direct, indirect, special, incidental, consequential or punitive damages of any kind, or any other type (whether by origin, including negligence), including without limitation, damages related to the use, misuse, reliance on, inability to use, and the interruption, suspension or termination of the site or services, damages caused by links included in or absent from the site, and damages caused by loss of use, sales, data, goodwill or profits, even when u4Bear has not been informed of such possibility, or you have informed of the same. Your sole right with respect to any dissatisfaction with this site or its services or u4Bear shall be to terminate use of this site and its services. In the event that your country and/or state does not permit the exclusion of liability for incidental or consequential damages, this prior disclaimer may not apply to you.

3.3 - Before using u4Bear's services, please carefully read the following terms and conditions of use. By accessing, consulting and/or using u4Bear's services, you acknowledge that you have read, understood and agree to all authorizations and disclosures set forth in this document, all of the following terms and conditions, including any future modifications to these terms and conditions of use, and all guidelines (collectively, the "agreement") without limitation or condition. If you do not agree with this agreement, please stop using u4Bear's services immediately.

3.4 - u4Bear's services are available exclusively to persons over 18 years of age (or over 21 in those places where the age of majority is not 18). Persons under the legal age are not permitted to directly or indirectly view, possess or use u4Bear's services. You affirm and warrant that you are currently of legal age and have the legal capacity to enter into and fulfill all obligations set forth in this agreement.

4.- On Safety
4.1 - u4Bear's services are intended solely for personal purposes, location services for individual use, and must not be used or considered as an emergency system. u4Bear should never be used while driving or operating vehicles, or in any environment that may be dangerous or require safety at any level, even minimal, and/or in any other situation where any lack of precision, however minimal, could cause death, personal injury or material or property damage at any level, even very low or unpredictable.

4.2 - You must not use u4Bear:
         4.2.1 - for any activity other than personal leisure.
         4.2.2 - for emergency situations, important communications or activities other than entertainment, leisure and activities that involve no responsibility whatsoever.
         4.2.3 - as a communication app designed for security, privacy or urgency.

4.3 - u4Bear does NOT offer any warranty regarding its service in terms of security, privacy, urgency or protection, as its service is not designed for these purposes or situations.

4.4 - u4Bear can be addictive. It is your responsibility to take this information into account and limit your use of our service if you may be affected by it. Use u4Bear responsibly.

4.5 - u4Bear's content may be offensive, as it may contain crude images, nudity and/or pornography. Please verify that you wish to view and use this type of content before registering for our service.

4.6 - Do not share content of any kind (text, photographs, videos or any other) or personal data through u4Bear that you consider dangerous, sensitive or that could put you at risk in any way.

5.- Data Protection
5.1 - The use of the service is also subject to our Privacy Policy and Cookie Policy, accessible from the main menu of the application or website. Continued use implies your acceptance thereof.
5.2 - Personal information provided through u4Bear will be processed in accordance with our Privacy Policy. Use of the service implies acceptance of said policy, which can be consulted in the "Privacy Policy" tab above.

6.- Intellectual Property, Trademarks and Copyright
6.1 - u4Bear, its logo, brand and design are trademarks or marks of u4Bear and may not be used without the express written authorization of u4Bear. All other trademarks not belonging to u4Bear that may appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by u4Bear.

6.2 - All content on the site, such as text, graphics, logos and software, and the compilation of all content on the site, are the property of u4Bear and are protected by Spanish and international copyright laws. Except as provided in these terms, reproduction of any content from the site is not permitted without the express written permission of u4Bear.

6.3 - Content from external links that appear in u4Bear: u4Bear is not responsible for the content of links appearing in u4Bear, but shares third-party content in good faith. For any questions regarding such content, you should contact its publisher and/or legitimate representative or owner, which will be available in the same publication, link, external window or embed. u4Bear shares this content in good faith and understanding that it has been legitimately provided by its publisher.

7.- Fees, Subscriptions and Payments
u4Bear offers 2 levels of user accounts:
- Free (basic): This level is offered by default to all users, for a limited period of 24 hours, renewable at u4Bear's discretion in 24-hour cycles. This level provides access to some of u4Bear's services in a limited or restricted manner. These limitations and restrictions are set by u4Bear and clearly disclosed during use of the service.
- VIP (paid): The VIP level provides access to all u4Bear services marked as VIP in addition to those marked as basic, except those sold separately using coins, for the period contracted by the user and subject to the limitations set forth in this agreement.

u4Bear reserves the right, if necessary, to limit, block or cancel the free level for a user, who may then only use their account at the VIP (paid) level. This will be notified within the service for the user's awareness. The user may at that point purchase VIP access as designated by u4Bear at the corresponding rates, or cancel their account.

8.- VIP Subscriptions and In-Service Purchases
u4Bear offers various paid products within its service. Each product offered will specify the service and price indicated on each individual sales page.

8.1 - Special terms for VIP subscription
The VIP subscription is valid for 1/3/6/12 months or for the period indicated on the sales page at the price indicated therein for each option. Payment will be charged to your iTunes / Google Play / PayPal / bank card account upon confirming the purchase. The subscription will renew automatically until you deactivate it at least 24 hours before the end of the current period. Your account will be charged the price shown in the payment screen header and renewed at the same price at the end of the current period. Subscriptions can be managed and deactivated via account settings within the App Store / Google Play / PayPal or the corresponding payment gateway on your own device after purchase. Cancellations are not possible during the active subscription period. Your subscription can be used on all your iOS / Android / Web devices.

8.2 - Special terms for the "VIP FOREVER" option
The expression "forever" means an indefinite period, with a guaranteed minimum of 2 years from the date of purchase, for the user's use of the VIP service for as long as u4Bear provides active service. This indefinite-term use agreement will automatically terminate if u4Bear ceases to provide service (once the guaranteed minimum period of 2 years has passed), if the user cancels their user account at any time, if their account is cancelled under the terms of clause 18 of this agreement, or if their account is blocked under the terms of clause 19. In the event that u4Bear ceases to provide service after the guaranteed minimum period of 2 years from the date of purchase, it must inform all "VIP forever" users with at least 60 days' notice via an in-app message, and no refund or compensation shall be due as the contract shall be deemed fulfilled. If u4Bear cancels the service for one or all users before the guaranteed minimum of 2 years from the date of purchase, it will make a proportional refund of the unused time up to the 2-year guaranteed minimum from the date of purchase to those entitled, calculated in days by dividing the price paid before taxes by 730 and multiplying by the number of days remaining to complete 2 years from the date of purchase.

8.3 - Terms for the purchase of digital currency (coins/diamonds)
When you acquire, purchase or receive digital products from u4Bear, such as coins or diamonds (among others), you do not own them. What you receive is a limited right to use them for services, products or the purposes designated by u4Bear, such as bulk messaging, virtual gifts and others.

8.4 - Special terms for the SHOUT service
The SHOUT service allows the user to send the same message to multiple recipients simultaneously. Messages sent through this service shall not be considered SPAM or UNSOLICITED ADVERTISING, provided they comply with the content policy established by u4Bear.
u4Bear will automatically send the message to the number of users selected by the sender, although the final number of recipients delivered may be lower, depending on the number of users available in the chosen geographic area.
u4Bear is not responsible for the content of messages sent through this service and reserves the right to review, intervene in or deny their sending at any time if it considers that the message violates the terms of use or compromises the interests, security or protection of u4Bear, its employees or its users. In the event of denial, and provided the user's account remains active, u4Bear will refund the corresponding amount in digital currency to the sender's account.

8.5 - Warranties, cancellation and refunds
         8.5.1 - u4Bear abides by the European warranty law (available at this link), which states that u4Bear is not obligated to cancel and refund amounts when dealing with: "online digital content, if you have already started the download or streaming and if you have accepted that by doing so you lose your right of withdrawal." u4Bear always activates its digital products immediately after purchase, which means they are considered used and therefore exempt from refund and outside the "14-day reflection period" offered by the community guarantee. In accordance with Article 103(m) of Directive 2011/83/EU on consumer rights, the right of withdrawal does not apply to digital content once the download or execution of the service has begun, provided the consumer has given their express consent and has acknowledged that they lose their right of withdrawal.

         8.5.2 - In the event that the user breaches this agreement or the use policy, resulting in their account being blocked (permanently or temporarily) or their use license being withdrawn, no reimbursement of unused time or any alternative compensation shall be made for having lost their right to the contracted service.

         8.5.3 - If the user cancels or deletes their user account, or their account is blocked under clause 19 or automatically deleted under clause 18 before the contracted VIP period expires, or if there is remaining coin balance and/or digital product purchases within u4Bear unconsumed in their account, the remaining unused VIP time and the remaining coin balance and/or digital products will be lost immediately and permanently.

8.6 - Transfers
Purchases cannot be transferred or shared between multiple u4Bear accounts, even if one of them has been cancelled, deleted, blocked or transferred. Each purchase is permanently, irreversibly and non-transferably associated with a single u4Bear user. Regardless of whether the u4Bear accounts belong to the same person, purchases are counted per u4Bear user, i.e. per use license.

8.7 - Price and subscription plan changes
We may change our subscription plans and their prices at any time we see fit. However, no price change or change to your subscription plans will take effect until at least 30 days after our notification, during which time you may cancel your automatic renewal if the new price is not acceptable, thereby cancelling the VIP service when the contracted period expires.

8.8 - Commitment period
u4Bear has no commitment period, so you can activate and deactivate your VIP subscription or delete your u4Bear account whenever you wish.

8.9 - Subscription cancellation by u4Bear
u4Bear may cancel any VIP subscription renewal for any user, for any reason and without explanation. The user will enjoy their VIP access for the period they have paid for, under the same conditions described in these terms and conditions of use.

9.- Proper Use of the Coins and Diamonds System
The coins and diamonds system has been designed to encourage fair and authentic user interaction. u4Bear reserves the right to review and audit any activity related to the sending, receiving, converting or withdrawing of coins and diamonds.

The following are strictly prohibited:
- Using multiple accounts, your own or those of third parties, for the purpose of simulating interactions, rewarding yourself or obtaining financial benefits in a fraudulent or manipulated manner.
- Carrying out circular or coordinated transactions between users to reach the minimum withdrawal threshold or artificially inflate diamond balances.
- Participating in any scheme whose purpose is to circumvent the limits, conditions or logic of the system.

In the event that suspicious, abusive or fraudulent behavior is detected in the use of the system, u4Bear may, at its sole discretion:
Temporarily or permanently block the account involved.
Retain, cancel or reverse coin or diamond balances associated with it.
Deny the right to withdrawals, conversions or refunds.

All diamond withdrawal requests are subject to automated and/or manual review. u4Bear may audit the transaction history and origin of diamonds before authorizing a payment.
We reserve the right to cancel or hold any withdrawal if we detect reasonable indications of:
- Circular interactions between accounts (for example, sending your own coin balance to a third-party user for conversion into diamonds)
- Coordinated conversion of coins into diamonds among a small group of users.
- Sending/receiving patterns designed to circumvent minimum withdrawal thresholds.
- Behaviors that simulate legitimate activity for the sole purpose of obtaining financial gain.

These actions may be applied without prior notice and without the need for public justification, provided there are objective factors or reasonable indications of abuse, in accordance with our internal review systems.

10.- Suggestions and Improvements
By submitting to u4Bear by any means any idea, suggestion, document or proposal, you agree that your comments do not contain confidential or proprietary information of third parties, that you are under no obligation of confidentiality, express or implied, that something similar to what you have submitted may already be under review or in development, and that you grant us an irrevocable, non-exclusive, royalty-free, perpetual and worldwide license to use, modify, publish, distribute and sublicense such feedback.

11.- Third Parties
The service may include links to other websites or applications. u4Bear does not control or endorse any of these third-party sites. You agree that u4Bear is not responsible for the availability or content of such sites. Use of third-party sites is at your own risk. Some of the services available through the u4Bear service are provided in connection with third parties and subject to the additional terms specified by those parties on their respective websites. This section is also an addition to clause 6.4 of this agreement. If u4Bear detects or is informed that a third-party link published on the platform contains illegal content or content contrary to these terms of use, it will proceed to remove it immediately.

12.- Prohibited Uses
12.1 - You understand, acknowledge and agree that you may not and guarantee that you will not:
         12.1.1 - Violate or breach the "Content Policy" annexed to this agreement and available in the top menu of this page.
         12.1.2 - Use u4Bear's services or any location information displayed in u4Bear's services to stalk, harass, abuse, defame, threaten or defraud other users, or collect or attempt to collect the location or personal information of other users. Disrespectful behavior toward other users is not permitted and may result in your account being blocked or suspended.
         12.1.3 - Use u4Bear's services for any commercial or non-private purpose, understanding that u4Bear's services are for personal use only and in no case commercial. It is expressly prohibited to solicit money, gratuities, gifts, tips or any type of compensation by any means or for any reason.
         12.1.4 - Use u4Bear's services for any illegal purpose or in violation of any local, state, national or international law, including without limitation, laws governing intellectual property and other property rights, data protection and privacy, import and export controls.
         12.1.5 - Make unsolicited offers, advertisements, proposals or send spam to other users on u4Bear. This includes, but is not limited to, commercial advertising, announcements, information, requests for charity, petitions for signatures or support, and professional services.
         12.1.6 - Impersonate another person or entity, falsely claim an affiliation with any person or entity, or access other u4Bear users' accounts.
         12.1.7 - Register multiple accounts for the same person or from the same device, IP or identifier.
         12.1.8 - Misrepresent or falsify the origin, identity or content of information transmitted through u4Bear's services.
         12.1.9 - Suppress, circumvent, disable, damage or interfere with the security-related features of u4Bear's services, or acts that prevent or restrict the use or copying of any content accessible through u4Bear's services, or acts that impose restrictions on the use of u4Bear's services.
         12.1.10 - Intentionally interfere with or damage the operation of u4Bear's services or any user's enjoyment of them, by any means, including overloading or spreading viruses, worms and other malicious code.
         12.1.11 - Post, store, send, transmit or disseminate any information or material that a reasonable person would consider objectionable, defamatory, offensive, indecent, pornographic, harassing, threatening, embarrassing, distressing, vulgar, hateful, racist, xenophobic, or otherwise inappropriate, regardless of whether such material or its dissemination is legal.
         12.1.12 - Post, store, send, transmit or disseminate any information or material that infringes patents, trademarks, trade secrets, copyrights, or any other intellectual property rights.
         12.1.13 - Copy, save, transfer, disseminate or use any material included in u4Bear, except that which has been sent exclusively to you, and in any case only for personal use.
         12.1.14 - Use the u4Bear service on equipment connected in any way to communication systems in vehicles, navigation, location, real-time route guidance, fleet management or similar applications.
         12.1.15 - Use the u4Bear service in hazardous environments requiring fail-safe performance or any other application where a failure or inaccuracy could directly lead to death, personal injury or serious physical or property damage.
         12.1.16 - Collect user data or carry out actions to redirect users to other social networks, websites or products outside of u4Bear.
         12.1.17 - Attempt to gain unauthorized access to u4Bear's services or any part thereof, other accounts, computer systems or networks connected to u4Bear's services, or any part thereof, through hacking techniques or any other means by which you may interfere or attempt to interfere with the proper functioning of u4Bear's services or any activity carried out within u4Bear's service.
         12.1.18 - Use any robot, spider, scraper or other automated means to access u4Bear's services for any purpose without the express written permission of u4Bear, or circumvent our robot exclusion protocols or other measures we may use to prevent or restrict access to u4Bear's services, or modify u4Bear's services in any manner or form, nor use modified versions of u4Bear's services, including (without limitation) for the purpose of gaining unauthorized access to u4Bear's services.
         12.1.19 - Prostitution or any sexual service for financial purposes, real or virtual, as well as any service or proposal that suggests or advertises it.
         12.1.20 - Carry out actions (including threatening, blackmailing or informing of the possibility of doing so) of any nature and anywhere, inside or outside of u4Bear, that defame or disparage u4Bear's services or that directly or indirectly attack the interests of u4Bear, its management or its employees. This does not limit any legal actions that may arise from such acts.
         12.1.21 - Users are prohibited from filing complaints against other users through the "report user" option or through any other means of contact with us, if such complaints lack valid grounds. In particular, the use of the complaints system for accusations that are false, motivated by unverified personal perceptions, or intended to cause harm or retaliate against another user will not be permitted. Complaints must be based on clear and objective evidence that justifies an investigation. If a false complaint causes any problem for the reported user or generates inconvenience in the investigation process, we reserve the right to block the complainant's account and/or withdraw their use license.
 

13.- Child Protection and Trafficking
We take child protection absolutely seriously (and include in the term "minor" also persons with disabilities requiring special protection), and u4Bear will take all actions within its power to prevent the use of our service by minors or any activity involving minors, including making any necessary police reports. u4Bear has ZERO TOLERANCE on any matter involving minors.

13.1 - u4Bear does not allow any illegal activity, but in particular prohibits access to its service without exception to persons under the age of majority (18 years), even if they wish to access it. Similarly, it pursues and penalizes any account created by a minor, whether by themselves or by a third party, even if that third party is of legal age.

13.2 - In the event that u4Bear detects that an account has been created by a minor, they will be expelled as soon as possible and their device blocked to prevent them from accessing the service again. All technical measures within our reach will be taken to prevent their access to the service.

13.3 - The user has the obligation to notify u4Bear (via the "report profile" option or from the contact page www.u4bear.com/help) of the presence of a minor within the service as quickly as possible and must avoid any contact of any kind through our service from the moment they become aware of it.

13.4 - In the event that u4Bear detects that a user was aware of a minor's presence in the service and did not report it, u4Bear may take action against that user and permanently expel them, irrevocably withdrawing their use license. If furthermore u4Bear detects that the user continued to exchange messages, photographs or any other activity (including live encounters) despite knowing that the person was a minor, u4Bear will take the appropriate legal steps to report these facts to the police and will use all available data to file the report.

13.5 - Any activity involving a minor (real or fictional) is expressly prohibited in u4Bear, even if such activity takes place outside of u4Bear. The exchange or publication of photographs (including those of family members) of minors is expressly prohibited, even if these images are not of a sexual nature. Conversations (real or fictional) involving minors of a sexual nature are not permitted and are expressly prohibited.

13.6 - u4Bear will act with full force, including through legal channels, against any activity involving minors that comes to its knowledge both within and outside our service. u4Bear will always act in the protection of minors, even in fictional cases or fantasies, and applies ZERO TOLERANCE on this matter and on any issue that involves or may involve minors.

13.7 - u4Bear does not permit, without any exception, activities in which a minor appears, even when this is a "simulation" carried out by an adult, such as (without limitation to these examples): wearing diapers, pretending to be a young child, using a child's voice, playing with toys as if one were a minor, etc. Any representation, of any kind, even in a humorous tone, that involves, simulates or implies behavior characteristic of a minor, is expressly prohibited.

13.8 - u4Bear has a zero-tolerance policy against any activity that promotes, facilitates or is related to human trafficking, sex trafficking, exploitation or any form of modern slavery. Any content, account or activity of this kind will be immediately removed and reported to the competent authorities. Users who detect this type of activity are obliged to report it to u4Bear via https://www.u4bear.com/help or through the "Report profile" button available on the platform.

14.- User Content
14.1 - u4Bear's services allow the submission of content and materials (such as photos, comments, ratings, ideas, notes, concepts or creative suggestions) between you and other users (user files), and the hosting, sharing and/or publication of such submissions. You shall be solely responsible for your "user files" and the consequences of creating and/or publishing them. In connection with user submissions, you affirm, represent and warrant that: you own or have all necessary licenses, rights, consents and permissions to use and authorize the use of your content on u4Bear, including intellectual property and property rights of others.

14.2 - u4Bear actively monitors all content managed on its network, through automated systems, Artificial Intelligence tools and human review, as described in the Privacy Policy and always within the framework of data protection regulations. This active monitoring does not imply that u4Bear assumes the role of author, publisher or editorial manager of user-generated content. Content that is detected as illegal, contrary to these Terms and Conditions or the Content Policy will be removed. The obligation to monitor and remove prohibited content has the sole purpose of protecting users and complying with applicable law, without this implying any responsibility on u4Bear's part for the content generated and published by its users. This monitoring applies to all content managed on the platform, including messages, photographs, videos, video calls and live broadcasts.

14.3 - You are solely responsible for your content, which once published cannot always be removed. You declare that you own or have the necessary permissions to use and authorize the use of your content. You cannot expect your content to be in any way sponsored or endorsed by u4Bear. u4Bear assumes no responsibility for your content under any circumstances.

14.4 - u4Bear may use your content in various ways, including publicly displaying, reformatting, incorporating it into advertising and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms ("other media"). Therefore, you hereby grant us an irrevocable, non-exclusive, royalty-free, sub-licensable or transferable license to use your content for any purpose. "Use" means to use, copy, reproduce or publicly display, distribute, modify, translate, create derivative works from, and otherwise exploit your content.

14.5 - Complaints Policy: u4Bear has a complaints procedure accessible to all users, content creators, and platform models.

— Every complaint triggers the automatic and immediate removal of the content from public and private visibility. Following this precautionary measure, the team will review and permanently resolve the issue within a maximum period of 12 hours.

14.6 - u4Bear assumes responsibility for ensuring that the platform and all content published on it comply with applicable law and these terms of use. No content creator, user or other third party assumes on behalf of u4Bear any responsibility for the platform's regulatory compliance.

15.- Target Audience
u4Bear is a network designed and aimed at men (male gender) who have or wish to have relationships with men. Therefore, in order to preserve the ideology, purpose of the product and the privacy of its users and/or clients, as well as to prevent misrepresentation, access to or use of the platform is restricted to men with clearly masculine traits and attitude, both cisgender and transgender, who identify themselves as men of the male gender. Any other audience will not be permitted access.
u4Bear does not discriminate against or reject any other sexual or gender identity (in fact we fund supporting campaigns in this regard and collaborate with other apps aimed at these or other audiences) and therefore this section should not be interpreted as a form of discrimination, but rather limits the use of its social network to offer a service to a restricted target audience.

16.- Advertising
u4Bear may display advertisements and other information adjacent to or included in its content. You have no right to any compensation for this type of advertising. The form, manner and scope of such advertising are subject to change without notice to you.

17.- Mandatory Compliance
You certify that all data, photographs, videos or any other material transferred through u4Bear is truthful and your own property.
You are required to inform u4Bear moderators and/or administrators (via the "report profile" or "report pic" buttons) of any violation of these regulations by another user.

18.- Indemnification
You agree to indemnify, defend and hold harmless u4Bear, its affiliated companies, its suppliers and partners against any type of claim, demand, action, losses, costs, damages and other liabilities, including attorney fees and/or court costs arising from or related to: your use or misuse of any location information or u4Bear's services in general, any violation of the rights of any other person or entity by you, any breach or violation by you of this agreement, or your use of u4Bear's services to meet another user in person or to locate and attend any offline location or event. u4Bear reserves the right to assume the defense and control of any matter for which you are required to indemnify and undertakes to cooperate with the legal defense system in such claims.

19.- Account Deletion Due to Inactivity
u4Bear reserves the right, in the event that an account has been inactive for more than 1 year, to delete it entirely including all associated data, except for those which must be retained for maintenance, legal right or legal requirement. Account deletion shall be considered as a cancellation requested by the user, with no right to a claim and no possibility of restoring the deleted data. The user may create their account again whenever they wish; however, it will be treated as a new account and will only be associated with data that was not deleted (for example, maintenance data).

20.- Breach
Breach of this agreement in whole or in part, including the "Content Policy" and the "Privacy Policy", will result in the withdrawal of the user's license under clause 2. u4Bear will also take whatever measures are necessary to protect the security of its service and may therefore permanently prohibit a person from accessing its service, creating new accounts or obtaining new licenses.

21.- Contractual Updates
We reserve the right, at our discretion, to change, modify, add or remove parts of this agreement or its guidelines at any time. Please review this agreement and all guidelines periodically for any possible changes. Continued use of u4Bear after the posting of any modification or change implies acceptance of those changes. Please note that additional and/or different terms and conditions may apply to services or products offered through one or more of our partners, advertisers or business partners, and you should refer to those before using such services or products. For any material change to this agreement or any guideline, you acknowledge and agree that the amended or modified terms will automatically take effect 30 days after their publication on the u4Bear website.

All models, actors and other persons appearing in visual depictions of sexually explicit conduct on this website were over eighteen (18) years of age at the time such depictions were created. 23.- Jurisdiction and Other Provisions
This agreement is accepted, signed, governed and interpreted in accordance with the laws and jurisdiction of Navarra, Spain, without giving effect to any conflict of laws principle. You expressly waive any jurisdiction and legal limitation that does not correspond to the laws and jurisdiction of Navarra, Spain. If any provision of this agreement and/or contract is found to be null, illegal or unenforceable for any reason, such provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of the remaining provisions. You and u4Bear agree that any cause of action or relationship with u4Bear's services must be commenced within thirty (30) days after the cause giving rise to it. Otherwise, such action will expire permanently.

All of our service is hosted in Europe (European Union), specifically in Spain and Germany. Please bear this in mind, as all your data will be processed and stored in Europe. As a result, the limitation, liability and enforcement of the law are understood under European framework regulations and specifically those of Spain. Your use of the Service or the submission of any information to us or our service will constitute your consent to the transfer of your information outside your country of residence, including to Europe, which may stipulate data protection rules different from those in your country.

Users of the application may use the in-app search feature to search for other users by various profile criteria, such as profile name, age, height, weight, geographic location, physical characteristics, relationship status or preferences, or residence information. Your profile information will be used for these searches. The application's user interface may include a feature to make certain profile information items non-public. However, even if you choose to make certain items of your profile information or other information non-public, if the user interface permits, sophisticated users who use the Application in an unauthorized manner may nevertheless obtain this information.

USER SUBMISSIONS
A user of the Service may voluntarily provide information, content and materials (such as images, comments, ratings, classifications, ideas, notes, concepts, creative suggestions or questions) about themselves and other users ("User Submissions") to the Service. DISTANCE INFORMATION
YOU UNDERSTAND THAT WHEN YOU USE THE APPLICATION, BY DEFAULT, INFORMATION ABOUT YOUR DISTANCE FROM OTHER USERS IS PUBLIC AND OTHER USERS OF THE APPLICATION MAY SEE THIS INFORMATION WITHIN YOUR PROFILE.
Users of the application may use the in-app search feature to search for other users by distance. Information about your distance from other users will be used for these searches. This information is public, but the application may include a feature to hide or change the accuracy of this information. However, even if you choose to hide the display of this information, sophisticated users who use the application in an unauthorized manner may still be able to determine your location.

LOCATION INFORMATION
The geographic location of a user of the Service may be used to determine which services, disclosures, features, content and information will be available to you, and certain services, disclosures, features, content and information available through the Service may only be available to users in certain geographic locations.

u4Bear uses external providers for the management of advertising, statistical data, customer service and payment processing. SECURITY
We use a variety of security technologies and procedures to help protect your information from unauthorized access, use or disclosure. No internet transmission, email, mobile application or method of electronic storage is completely secure or error-free. Email or other communications sent through the Service may not be secure. You should exercise caution whenever you send information through the Service and take special care when deciding what information you provide to us.

SECURITY MONITORING AND CONTROL
At u4Bear we have a security department composed of authorized professionals trained by the company, who are subject to strict confidentiality agreements, complying with the highest ethical and legal standards within the European regulatory framework. This team has access to all content managed on our network, including private, temporary, ephemeral and real-time data. Their primary mission is to ensure the security of both our users and the platform, through continuous monitoring of generated content.

To support this process, we may use Artificial Intelligence (AI) tools to analyze conversations and photographs in search of behaviors or content that could be considered abusive, illegal or contrary to our policies (for example, grooming, identity theft, scam attempts, nudity, violence, drawings or images without people). These tools act in an auxiliary capacity, do not automate sanctions or make decisions without human review, and their sole purpose is to assist the security team in the early detection of potential risks.

Processing through AI systems is carried out through specialized providers, such as OpenAI (for conversation and image analysis) and Google Cloud Vision (for automated moderation of photographs and other visual content).

- We endeavor not to send unnecessary personally identifiable data to OpenAI; OpenAI does not use our data to train its models, does not store it permanently and, according to its API policy, may retain it temporarily for security/abuse purposes (e.g., up to 30 days). We will apply reduced retention options if the provider enables them for our account.

- Google Cloud Vision temporarily processes images submitted by users with the aim of detecting web matches and analyzing potential security risks. This processing is carried out on Google Cloud infrastructure, which may be located outside the European Union, under Standard Contractual Clauses approved by the European Commission, in compliance with the General Data Protection Regulation (GDPR). Google does not permanently retain the images or use them to train its own models without express authorization. These providers act as data processors in accordance with Article 28 GDPR, under our instructions, with data processing agreements and Standard Contractual Clauses where applicable.

This processing is carried out under the legal bases of u4Bear's legitimate interest, and in compliance with the General Data Protection Regulation (GDPR) and applicable Spanish legislation.

The staff of this department are obliged not to extract, share or disclose under any circumstances the information to which they have access, and not to take any action on the content, except in exceptional situations requiring intervention, such as illegal activities or violations of our policies. If necessary, and in accordance with the law, they may provide evidence solely to judicial or law enforcement authorities within the framework of a formal complaint. The confidentiality commitment of these professionals is of indefinite duration, thereby guaranteeing the maximum protection of information in the long term.

THIRD-PARTY WEBSITES AND MOBILE APPLICATIONS

EXCEPTION FOR ACCOUNT BLOCKING OR SYSTEM EXPULSION
There is a specific exception when a user violates u4Bear's terms of use. If the violation is considered "minor", the user may unblock their account and resume normal activity. However, if the user is expelled for a serious violation, u4Bear will retain, under the legal basis of legitimate security interest, the minimum necessary identifiers (such as device identifier or email hash) in encrypted and locked form. This data is kept for the sole purpose of preventing the re-entry of the offender and protecting the integrity of the community. This information is not accessible for commercial use, will not be visible on the social network and will be retained for as long as necessary to guarantee access blocking.

· Identification Required: For your own security, to exercise any right other than through your account control panel, it is strictly necessary for the user to identify themselves unequivocally. If you do not have access to your account, do not remember your credentials or do not have access to the registration email, u4Bear will not be able to provide you with any personal information, as we cannot verify that you are the legitimate holder of the data.
· Right to Erasure (Deletion): The user may delete their data immediately and permanently via: https://www.u4bear.com/delete.
· Limitation of the Right to Erasure: In accordance with the GDPR, u4Bear reserves the right not to delete minimal data (identifiers) that are necessary to comply with legal obligations or to maintain security blocks for serious violations of our rules, in order to protect the community and cooperate with authorities if required.

• c.1 - Where the obvious focal point is the underwear and/or swimwear (crotch area).
• c.2 - In swimwear or shorts (for example, thongs or bikini-style) except in outdoor settings (beach, pool, etc.) and provided that the outline of the genitals is not visible, nor are the genitals or buttocks excessively accentuated.
• c.3 - With open trousers showing underwear.

d) SEXUAL

• d.1 - Depicting suggestive or explicit sexual acts, whether real, illustrated, simulated or partially concealed.
• d.2 - With postural expressions that suggest sexual or erotic activity, even if the area of the body shown is not in itself sexual, genital or nude (for example, squeezing breasts, touching nipples, an erotic kiss, a sexual pose without nudity, an exaggerated bulge under clothing, etc.). This restriction applies equally even with humorous or artistic intent, as long as the pose, context or staging can be interpreted in a sexual manner.
• d.3 - With sexually suggestive clothing.

• e.1 - Where the user does not appear clearly in the photo.
• e.2 - That do not belong to the user and/or are stealing the identity of another person, famous or otherwise.

• e.4 - Where you do not hold the copyright and/or usage rights.
• e.5 - That may give reason to suspect that it is not the user themselves, including images that may mislead or cause confusion about the actual identity, for example by using filters, retouching or edits (on the face or any visible part) that substantially alter their appearance or make identification difficult.
• e.6 - Content that has been created, modified or generated by (or with the help of) Artificial Intelligence (AI).
• e.7 - Photographs in which the face appears completely covered by masks, helmets, eye masks or other similar elements, preventing identification of the person, unless the image is full-body or sufficiently wide to recognize the person by their build, clothing or other visible features. Images will not be accepted where, even if the whole body is visible, the clothing prevents reasonable recognition of the user (for example, full costumes such as complete superhero suits, morphsuits or inflatable costumes).
• e.8 - Photographs that only show isolated parts of the body (for example, only arms, legs, back or torso) without it being reasonably possible to identify the user.

General content
     The following content is not permitted:

f) MINORS

• f.1 - Showing persons under 18 years of age, or persons simulating being under 18 years of age, or where there may be doubt as to whether they are of legal age, whether alone or accompanied, even if their face is covered, even if the person is currently of legal age. Under no circumstances and in no way may a minor appear on u4Bear.

g) DRUGS

• g.1 - Showing, inciting or suggesting illegal or legal drugs, their use or related paraphernalia.

h) ABUSE

• h.1 - Depicting violent, abusive or degrading acts, against yourself or against any person or animal, whether consented to or simulated. This includes BDSM actions, fisting or acts that could be considered excessive in the general opinion.
• h.2 - Where any of the participants may (or may appear to) not be conscious or be at a disadvantage: persons who are drunk, drugged, have a disability requiring special protection, or any other cause of this nature.
• h.3 - Containing blood, wounds, feces (or similar), urine, flatulence or bodily fluids, whether real and/or simulated.
• h.4 - Showing weapons, knives or any object of violence (real or simulated).
• h.5 - Publication of content of a political or religious nature is not permitted under any circumstances. Likewise, any material that may generate controversy, emotional, moral or physical harm, as well as content that incites racism, intolerance, hatred or any type of prejudice against third parties is prohibited.
• h.6 - Any content that could be considered objectionable, defamatory, offensive, indecent, harassing, threatening, embarrassing, distressing, vulgar, hateful, racist, xenophobic or otherwise inappropriate, regardless of whether such material or its dissemination is legal.
• h.7 - Containing images of sex with or between animals.
• h.8 - Intended to threaten, intimidate, harass, defame or insult another person.
• h.9 - Containing profanity, insults or curses, including abbreviations, masking and fillers.

• h.11 - Any material in which a minor participates, or that simulates in any way a person under age (18 years), even if the simulation is carried out by an adult (for example, pretending to be a child or adopting attitudes, wearing clothing or using any other object or action that evokes what would be appropriate for a minor), even if such images, texts or material are not sexually explicit.

i) QUALITY

• i.1 - Where the quality is insufficient due to lack of light, cropping, size, focus, excessive compression, use of filters, stickers or distortions, or because it is excessively cropped, enlarged or pixelated in a way that conceals details relevant to moderation or identification.
• i.2 - The video or live broadcast, at u4Bear's discretion, does not have sufficient quality to be considered of interest.

j) ADVERTISING

• j.1 - Containing advertising messages, URLs, brands and/or logos, websites, notices, instructions, etc.
• j.2 - That are screenshots of other applications, including those of a device's own operating system.
• j.3 - That contain only text or where the majority of the image consists of text.
• j.4 - Containing massage services, escort services (including prostitution or companionship services) or any type of business.
• j.5 - Showing telephone numbers, social media identifiers or any personal data such as email address, website or postal address.
• j.6 - Containing text that we cannot translate or interpret, or that includes QR codes, hidden links or other elements intended to redirect traffic to external sites.

Acts and actions
     The following acts or actions are not permitted:

k) ACTS:

• k.1 - Attempting to obtain another user's location without their voluntary consent.
• k.2 - Being disrespectful, stalking, harassing, abusing, defaming, threatening or defrauding other users, whether directly or indirectly, using u4Bear.
• k.3 - Sending unsolicited messages or making posts not previously authorized by u4Bear to promote any activity, whether professional or not, even if no benefit accrues to the sender.
• k.4 - Any activity that involves money, including for example (but not limited to): prostitution, massages, sugar daddy arrangements, etc.
• k.5 - Any activity or content that is illegal or violates local, state, national or international laws.
• k.6 - Using content that infringes copyrights or patents from any part of the world.
• k.7 - Impersonating another person, in any form.
• k.8 - Registering multiple accounts for the same person.
• k.9 - Falsifying or misrepresenting any content you post or send.
• k.10 - Sending viruses, worms, trojans or any computer infection.
• k.11 - Saving, copying or capturing any content from u4Bear that has not been voluntarily sent to you by the user for that purpose.
• k.12 - Collecting any data, for any purpose, from any user or from u4Bear itself.
• k.13 - Using computer applications (such as bots, robots or any other automated tool).
• k.14 - Sending links, usernames, or any other data or means to request that a user make contact outside of u4Bear or to create lists, groups or contacts of users.
• k.15 - Facilitating, promoting or coordinating activities outside the platform that violate these rules, even if not directly published in the content or profile.

Exceptions
     The following exceptions shall apply:

m) LIVE AND VIDEOS (STORIES):

• m.1 - Rules a), b), c) and d) are excluded and therefore permitted in the LIVE and VIDEOS (STORIES) tabs.
• m.2 - All other points of this "Content Policy" shall apply equally and mandatorily. Under no circumstances does the permissiveness of point m.1 cover content that violates the rules on minors (f), drugs (g), abuse or violence (h) and illegal acts (k).
• m.3 - Content published in the LIVE and VIDEOS (STORIES) tabs will be hidden by default, under the sensitive content filter which the user may deactivate at their own request and responsibility.
